This book, after presenting a method for classifying the principles of jurisprudence, deals with the history of the knowledge of the principles of Sunni and Shi’ite. In the critical way, the most important Shi'ite and Sunni principles, their books and ideas as well as the history of the most important issues of jurisprudence are discussed. The study of this history also mentions important historical periods in the science of its principles and schools.
The second chapter of this book is called "precept", which defines religious precept and its types, and then the philosophy of the injunctions. The methods of identifying the expediency and maqāṣid al-sharī'a, its applications and challenges, and the extent to which religious precept is learned, are other topics that will be discussed in this chapter.
The third chapter is devoted to the sources of precept. The intellect, the Holy Qur'an, the tradition and the consensus are the sources that the clergyman uses to discover religious precept. Each of these sources faces old and new challenges faced by Shi'ite and Sunni scholars and Orientalist. In this section, the scope of each source has also been identified.
The last part of this chapter deals with the important issue of interpretive reasoning. Judicial reasoning by analogy, consideration of the public interest, juristic preference and closing off the means that can lead to evil are some of the methods of Sunni interpretive reasoning that have been reviewed in this section and the following are also shown the correct methods of interpretive reasoning for the Shi'ite and then the disagreement in the interpretive reasoning.
"Textology" is the fourth chapter of the book. This chapter deals with the relation between linguistic knowledge and the principles of jurisprudence. In one of the most important parts of this book, following the genealogy of the rhetoric in the principles of jurisprudence, we have referred to the Greek roots of some of the famous theories of rhetoric. Finally, we have shown that, contrary to popular opinion, the principles of the literal principles are not justified. Then, in the light of the linguistic theory we propose as the "sign learning theory" and after the critics' views examination, we choose our own point of view in other disciplines of theology such as the question of status, the truth of the law, the general, proper and the derivative, command and prohibition, the obligatory antecedent, command and prohibition consensus, the concepts, the general and the specific and absolute and bound.
In the following, the principles are discussed and in particular the legitimacy of the continuity is denied.
In the last chapters of the book, an intensive course on the traditional topics of jurisprudence science has been examined, and in each of these issues, the views of the Shi’ite and Sunni antecedents and theories have been illustrated as well as contemporary perspectives and challenges.
In addition, in each subject it has been attempted to express the author's independent view and its reasoning. In the meantime, many of the most popular topics in the science of principles have been reviewed and revised.
This book can be suggested as a textbook for MA and Ph.D. in jurisprudence and law as well as superior jurisprudence courses at the seminary school. Writing based on academic standards, meticulous references, comparative reviews, presenting the views of early and late theologians as well as explaining each chapter's preferences and impartiality and Free thought in designing various themes and initiatives. The principles in this book are characteristic of this work.
Author About:
Born in 1972 in Mashhad, Iran, Mohsen Abbasnejad was took his BS in Mechanical Engineering but continued his studies in Philosophy. Having studied Islamic Jurisprudence and Usool in seminary under the late Ayatollah Mirza Ali Falsafi, a great contemporary jurist, and Philosophy under the late Sayyed Jalal Ashtiani, a distinguished philosopher of the Eastern World, he passed the higest levels of the seminary with flying colors.
Having authored number of works in such fields as philosophy, philosophy of science, Modern kalam (literally known as Science of discourse), Quranic sciences and Hadith, and Jurisprudence, Mr. Abbasnejad is now serving as the head of the Department for researching on Quran and Epistemology, and the Director of the Quranic Research Foundation.
